RELEASE: Mrvan legislation to become law

INDIANAPOLIS- During the recently adjourned legislative session, State Senator Frank Mrvan (D-Hammond) proposed several initiatives that were approved by the General Assembly and are expected to be signed into law by the governor. Most new laws become effective July 1, 2014. These initiatives include topics concerning veterans, business finance, and health and human services.

Sen. Mrvan co-authored Senate Enrolled Act (SEA) 50, which enforces regulations prohibiting the use of tanning beds by individuals 16 years of age or younger, unless a parent or guardian signs a release form in the presence of the tanning facility operator. The proposal was a recommendation from the Health Finance Commission, which studied this topic last year. Testimony revealed that tanning bed use, especially among children and teens, has brought on an increased risk of melanoma and non-melanoma skin cancers associated with artificial tanning, due in part to the fact that artificial tanning lamps and beds generate up to 10 to 15 times more damaging UV light than sunlight.

SEA 222, co-authored by Sen. Mrvan, increases requirements for youth and high school football coaches. Under this act, coaches will be required to take a concussion awareness course once every two years to become certified on how to better care for athletes who suffer concussion accidents. This initiative also requires a 24-hour waiting period before an athlete who has suffered a concussion or other head injury can return to play. Additionally, the measure provides civil immunity in certain circumstances for coaches who have completed the training.

Sen. Mrvan co-authored  SEA 331, which aims to attract veterans to teaching professions. SEA 331 will establish the Second Service for Veteran Program, which will require state universities to implement a policy to award educational credits to veterans or individuals serving in the United States Armed Forces or the Indiana National Guard. These credits will be awarded to those who have completed courses if they apply to the individual’s college degree requirements.

Co-authored by Sen. Mrvan, SEA 375 assists small businesses and facilitates small business local investments. SEA 375 exempts the sale of certain types of securities by an issuer from provisions under the Indiana Uniform Securities Act. Among other provisions, the bill specifies the requirements for the transaction to qualify for the exemptions.

Another proposal co-authored by Sen. Mrvan, SEA 406 makes certain procedural changes to the False Claims Act and Medicaid False Claim Act to remove inconsistencies and comply with federal law. The act also requires the state Family and Social Services Agency to provide reports of a child's vision impairment diagnosis to the state Department of Health for inclusion in the Birth Problems Registry. Another provision of the act changes asset limitations within the Community and Home Options to Institutional Care for the Elderly and Disabled program (CHOICE) from $500,000 to $250,000 as of January 1, 2015.
