[ATG] Zoeller: U.S. Supreme Court upholds tradition of legislative prayer

INDIANAPOLIS -- Today the United States Supreme Court issued its decision in the Town of Greece, N.Y. v. Galloway et al. case, holding the town did not violate the Establishment Clause of the First Amendment by allowing citizens to offer public prayer prior to the start of town legislative meetings. The Indiana Attorney General’s Office was co-author with Texas of an amicus brief joined by 21 other states in support of the Town of Greece and filed August 2 with the U.S. Supreme Court. Indiana Attorney General Greg Zoeller today issued this statement on today’s decision:

“Across Indiana and our nation, the tradition is that elected councils, boards and legislatures open their sessions with an invocation as a free expression by citizens of religious faith. In our amicus brief, we contended elected officials ought not be placed in the position of having to screen prayers for sectarian references, and we are pleased that the U.S. Supreme Court has in part agreed and underscored the validity of this honored tradition in representative democracy,” Zoeller said.

The Indiana Attorney General’s Office represents the State of Indiana in court and routinely participates in amicus briefs filed before the U.S. Supreme Court. Today’s U.S. Supreme Court decision overturns a U.S. Second Circuit Court of Appeals ruling that disapproved of the Town of Greece’s practice of citizen-led prayer prior to legislative meetings.
