A categorical exclusion is a category of actions which do not individually or cumulatively have a significant effect on the human environment and which have been found to have no such effect in procedures adopted by an agency in implementation of the regulations adopted under IC 13-12-4-5 and for which neither an environmental assessment nor an environmental impact statement is required.
Activities which are categorically excluded are either minor in nature or have been subjected to procedures that are functionally equivalent to those described in IC 13-12-4-5 or in regulations implementing the National Environmental Policy Act of 1969, as amended, 42 U.S.C. 4321 et seq., at 40 CFR 1500 through 40 CFR 1508. Categorical exclusions are the same as categorical exemptions as described in 326 IAC 16-1-3(e), 327 IAC 11-1-3(e), and 329 IAC 5-1-3(e). The following IDEM actions are categorical exclusions or exemptions under 326 IAC 16-1-3(e), 327 IAC 11-1-3(e), and 329 IAC 5-1-3(e) and do not constitute major state actions significantly affecting the quality of the human environment:
