State statutes establish rulemaking boards, which provide authority for each board to adopt rules to regulate various air pollution, solid and hazardous waste, or water pollution matters.

When adopting rules, the environmental rulemaking boards and the department must follow procedures set out in Indiana law in IC 4-22-2 and IC 13-14-9. These rulemaking procedures are different from the procedures that apply to other Indiana agencies.

Title 326 Air Pollution Control Board

Statutory Authority:

The Air Pollution Control Board (APCB) is established under IC 13-17-2. State statutes provide authority for the APCB to adopt rules regarding various air pollution matters. For example, IC 13-17-3-4 provides that the board shall adopt rules necessary to the implementation of the Federal Clean Air Act as amended in 1990. More generally, IC 13-17-3-4 provides that the board shall adopt rules consistent with the legislature's intent to, for example, safeguard the air resource through the prevention, abatement, and control of air pollution by all practical and economically feasible means.

Representation:

The board has twelve members, a technical secretary, and a legal counsel. The technical secretary and legal counsel are non-voting members of the board, and may not be state employees. There are four (4) ex officio representatives on the board, who represent other state agencies. The remaining eight (8) members are representatives of various constituencies, and are appointed by the governor. The procedure the board and the department must follow in adopting rules is also set out in statute, in IC 13-14-9.

Title 327 Water Pollution Control Board

Statutory Authority:

The Water Pollution Control Board (WPCB) was established as an independent board under IC 13-18-1. State statutes provide authority for the WPCB to adopt rules regarding various water pollution matters. IC 13-18-3-2 provides the board the authority to adopt rules necessary for the implementation of the Federal Water Pollution Control Act and the Federal Safe Drinking Water Act. IC13-18-3-1 provides the board the authority to adopt rules for the control and prevention of pollution in waters of Indiana and prevent any aquatic life or any beneficial animal or vegetable life from being destroyed or injured.

Title 328 Underground Storage Tank Financial Assurance Board

Statutory Authority:

The Underground Storage Tank Financial Assurance Board (FAB) was established under IC 13-23-11 by Indiana statute to adopt rules to regulate payment of claims from the Excess Liability Trust Fund, under IC 13-23-8. Representation:

There are sixteen board members. The procedure the board and the department must follow in adopting rules is also set out in statute, in IC 13-14-9.

The Excess Liability Trust Fund Rule was officially adopted by the Financial Assurance Board on November 16, 2001. Any costs incurred on or after that date will be paid at the new rates listed under 328 IAC 1-3-5.

Title 329 Solid Waste Management Board

Statutory Authority:

The Solid Waste Management Board (SWMB) was established by Indiana statute to:

  1. Adopt rules under IC 4-22-2 to regulate solid and hazardous waste and atomic radiation in Indiana, including rules necessary to the implementation of the federal Resource Conservation and Recovery Act (42 U.S.C. 6901 et seq.), as amended;
  2. Develop operating policy concerning the activities of the department; and
  3. Carry out other duties imposed by law. (See IC 13-19-3-1.)

Representation:

The board consists of 14 members. Ten members are appointed by the governor to represent specific constituencies. Four (4) ex officio members represent other state agencies involved in environmental issues. The board retains an independent board counsel, Ms. Deborah Albright, and an independent technical secretary, currently vacant. Neither the board counsel nor the technical secretary may vote on board actions.
