Brief Introduction

IEERB's statute holds the agency responsible for providing mediation and fact-finding for all Indiana teacher bargaining processes at impasse. Upon notification by the parties that bargaining has reached an impasse, the Director of Conciliation provides a qualified mediator or fact-finder to assist with the dispute.

Mediation Process and Procedures

What is mediation and what does a mediator do?

A mediator, as provided for by the statute, delineates the problems involved in bargaining, seeks solutions which can reasonably be accepted by both parties, and determines common grounds for agreement. Mediators act as facilitators, assisting the parties as they attempt to move toward settlement. Techniques used by mediators are many and varied.

Fact-Finding Process and Procedures

What is fact-finding and what does a fact-finder do?

When the parties are unable by themselves, or through a mediator, to resolve a dispute, a fact-finder investigates, holds a hearing, and issues a neutral advisory opinion as to the settlement of the dispute.
