ACLU of Indiana, Indiana Protection and Advocacy Services Win U.S. District Court Decision Regarding Inhumane Treatment of Prisoners. State violated rights of mentally ill inmates at Indiana prisons. On 12/31/12, a federal judge ruled in IPAS v. Indiana Department of Correction (IDOC), that "The treatment of mentally ill prisoners housed in [Indiana Department of Correction] IDOC segregation units and the New Castle Psychiatric Unit, and the failure to provide adequate treatment for such prisoners, violates the Eighth Amendment's proscription against the imposition of cruel and unusual punishment." Indiana Protection and Advocacy Services Commission will hold an Executive Session at 9:00 a.m. EST, Saturday, February 9, 2013, at the IPAS office in the VNS Building, Second Floor, at 4701 North Keystone Ave., Suite 222, Indianapolis, Indiana. An Executive Session will be held to discuss a job performance evaluation of individual employees, pursuant to Ind. Code 5-14-1.5-6.1(b)(9).   Indiana Protection and Advocacy Services Commission will hold the quarterly meeting following the Executive Session at 9:45 a.m.

It could promise and deliver much for good or for ill, for individuals with disabilities. IPAS wants to encourage individuals with intellectual and developmental disabilities, and their family members or guardians, to call IPAS if you are experiencing problems securing appropriate special education services or are being suspended or expelled due to disability, are being secluded or restrained in the school setting, are being discriminated against due to disability, or are having Medicaid waiver services inappropriately reduced. The Indiana Council on Independent Living is now developing the goals to be included in the 2013-2015 State Plan for Independent Living. Autism Commission Approves Draft Legislation on Seclusion and Restraint in Schools The Indiana Commission on Autism has approved preliminary draft legislation regarding the use of seclusion and restraints in Indiana schools. Indiana is 1 of only 19 states that do not have a law protecting children from seclusion and restraint in schools.  If approved, the legislation would:   
• Require all students be treated with dignity and respect
• Require school corporations to develop a policy and have it approved by their governing body
• Require training of appropriate school employees
• Require parental notification in a reasonable time frame

Indiana's Family Supports Medicaid Waiver. On September 1, 2012, the new Family Supports Waiver will replace the former Support Services Waiver. Individuals who currently receive services under the Support Services Waiver will now receive services under the Family Supports Waiver. For more information click here

Public Policy Advocacy Opportunity Available - Indiana Protection and Advocacy Services Commission (IPAS) is always looking for new Commission and Mental Illness Advisory Council (MIAC) members. Members must have a commitment to promoting the legal and civil rights of people with developmental disabilities, mental illness or other disabilities, and to the cause of protecting and promoting those individuals’ rights to make their own choices.
