Section 5. Education Requirement for Provisional License and Business Counsel License.
Within twelve (12) months of an applicant's initial provisional license or business counsel license admission, the applicant shall attend an annual Indiana law update form , which forum shall provide a minimum of 12 hours of continuing legal education, which has been approved by the Indiana Commission For Continuing Legal Education. Applicants admitted on provisional license or business counsel license are subject to, and shall comply with, the Indiana Rules For Admission to the Bar and the Discipline of Attorneys, the Rules of Professional Conduct, and all other requirements of statute and Supreme Court Rules.
Admission and Discipline Rule 29
A & D Rule 29 governs mandatory CLE requirements for every attorney admitted to the Indiana Bar. Attorneys admitted on foreign license or business counsel license should be aware of the following section:
Section 3 (c) specifically states that “…attorneys admitted on foreign license or business counsel license…shall be given no grace period, but shall commence their yearly education period minimum requirements effective the January 1 prior to admission.”
Section 3 (a) of this rule sets out CLE requirements for Indiana attorneys. “Every Attorney and every Judge of a city, town or Marion County small claims court, who is not licensed and an Attorney, shall complete no less than six (6) hours of approved continuing legal education each year and shall complete no less than thirty-six (36) hours of approved continuing legal education each Education Period. At least three (3) hours of approved continuing legal education in professional responsibility shall be included within the hours of continuing legal education required during the three (3) year Education Period. Such hours may be integrated as part of a substantive program or as a freestanding program. All credits for a single educational activity will be applied in one (1) calendar year. No more than twelve (12) hours of the Educational Period Requirement shall be filled by Non Legal Subject matter Courses.
