The Indiana Commission on Judicial Qualifications issued an advisory opinion dealing with a judge's ability to personally accept compensation for solemnizing marriage ceremonies during court hours. The Commission's view is that Rule 1.3 of the Code of Judicial Conduct requires judges who perform wedding ceremonies during the court's regular hours to remit the funds received for these services to the court; by receiving personal compensation for judicial duties performed while the court is open and conducting business, judges may be perceived as using their judicial position for pecuniary gain.
