Judicial Qualifications issues Advisory Opinion

The Indiana Commission on Judicial Qualifications issued an advisory opinion dealing with ex parte guardianship petitions and Trial Rule 65(B). To comply with the requirements of Trial Rule 65(B) and the Code of Judicial Conduct, judges who receive ex parte petitions for emergency guardianship must ensure that the petition contains sufficient facts and proof of attempted notice (or an explanation of why notice should not be required) before granting the order. These facts should be included in a written order if the petition is granted.
