FIRST ORDER OF INTERIM APPOINTMENT OF

SENIOR JUDGES

The judges of the trial courts listed in Exhibit “A” and in Exhibit “B” to this Order have requested appointment of senior judges for service in their respective courts during the year 2004, pursuant to Ind. Code §33-4-8.1.

This Court adopted revisions to Administrative Rule 5 on December 3, 2003, which made certain changes to the senior judge program in recognition of the importance of senior judges to the administration of justice in Indiana trial courts. Accordingly, we find that the courts listed on Exhibit “A” to this Order have demonstrated the need for additional judicial resources based on those courts’ 2002 weighted caseload statistics. We find further that those courts listed on Exhibit “B” are eligible for limited senior judge assistance as contemplated by the revisions to Administrative Rule 5. We find further that each senior judge listed on Exhibit “A” and on Exhibit “B” has been certified as a senior judge by the Judicial Nominating Commission for the calendar year 2004 pursuant to Ind. Code §33-2.1-4-17. In June 2004, this Court will re-examine the appointments made herein in light of 2003 weighted caseload statistics, and will make adjustments accordingly.

IT IS, THEREFORE, ORDERED that the senior judges listed herein on Exhibit “A” are appointed to serve in the requesting trial courts at the discretion of the requesting judge, effective January 1, 2004. These appointments shall remain in effect until June 30, 2004. Thereafter, these appointments are subject to being altered in light of 2003 weighted caseload statistics and the amendments to Administrative Rule 5. Pursuant to Ind. Code §33-4-8-5, all senior judges appointed by this Court in this Order may not be compensated as senior judge for more than one hundred (100) days in the aggregate during the 2004 calendar year.

IT IS FURTHER ORDERED that the senior judges listed herein on Exhibit “B” are appointed to serve in the requesting trial courts for a maximum of five days, effective January 1, 2004. These appointments shall remain in effect until June 30, 2004, and it shall be incumbent upon the requesting judge to ensure that the requesting court utilizes no more than five (5) senior judge service days prior to June 30, 2004. Pursuant to Ind. Code §33-4-8-5, all senior judges appointed by this Court in this Order may not be compensated as senior judge for more than one hundred (100) days in the aggregate during the 2004 calendar year.

The Clerk of this Court is directed to forward a certified copy of this Order to each of the senior judges listed herein in Exhibit “A” and in Exhibit “B”, to the clerk of each trial court listed herein in Exhibit “A” and in Exhibit “B” for entry of this Order into the Record of Judgments and Orders for those courts, to the Indiana Judicial Center, and to the Division of State Court Administration Payroll Section.

The clerk of each trial court listed herein in Exhibit “A” and in Exhibit “B” is directed to forward notice of this order to the presiding judge of the requesting court.
