ORDER REMANDING JURISDICTION TO TRIAL COURT
Comes now the Hon. Douglas A. Tate, Judge of the Howard Superior Court 3, and on his own motion recuses himself and remands this cause to the Court for appointment of a special judge pursuant to Ind.Crim.Rule 13.
And this Court, being duly advised, now finds that jurisdiction of this matter should be remanded to the Howard Superior Court and Judge Tate for the appointment of a special judge as provided in Crim.R. 13(C)
IT IS, THEREFORE, ORDERED that jurisdiction of this matter is remanded to the Howard Superior Court and Judge Tate for appointment of a special judge pursuant to local rule.
The Clerk of this Court is directed to forward notice of this Order to the Hon. Douglas A. Tate, Howard Superior Court, Courthouse, #110, Kokomo, IN 46901-9004, and to the Clerk of the Howard Superior Court.
The Clerk of the Howard Superior Court is directed to forward notice of this Order to all parties of record in the case below.
