Projects & Initiatives

The Division of Hearings serves the Natural Resources Commission in the performance of its various statutory responsibilities. The most prominent of these responsibilities are for adjudications and rule adoptions. The Division also assists the Advisory Council, a board which provides advice to the Commission and to the Department of Natural Resources.

Currently, the Division is pursuing an initiative through the Advisory Council that may result in a nonrule policy document or rule to help describe how riparian zones are delineated in public freshwater lakes and navigable waterways. "Riparian Zones in Public Waters" was initially considered by the Advisory Council during its meeting of April 10, 2007, and it is intended to provide information for the development of the nonrule policy document or rule.

The Division recently completed an initiative with the Office of Environmental Adjudication ("OEA") to implement provisions of 2005 SEA 619. As a result, parallel rules were adopted for the Division at 312 IAC 3-1-2.5 and for OEA at 315 IAC 1-1-2 to identify what are considered the "applicable provisions of the code of judicial conduct".
