FSSA Releases Statement on Rule Change

Today at the Indiana Medicaid Oversight Committee it was brought forth that the Family and Social Services Administration (FSSA) has contemplated a rule change to move from the current federally acceptable 30/60 day standard for Food Stamp application processing, to a federally preferred, pure 30-day standard.

In the most recent letter dated August 19, from the United States Department of Agriculture, Ollice Holden, Regional Manager of the Food Stamp program, clearly states that Indiana has improved its 30-day timeliness standard to 88.67 percent. While no final decision has been made, FSSA looks forward to receiving public testimony on this possible rule change at the previously scheduled meeting on September 4, 2008 at 1:00 in the Government Center South, Conference Room 5.

The state's rule making process takes anywhere from nine to twelve months to complete and FSSA will continue to work with the federal government and listen to feedback before any final decision is made. 

The FSSA rule making process is as follows:

Notice of intent

  1. Submit fiscal impact, cost benefit and small business impact analysis to state budget agency and the Indiana Economic Development Corporation (IEDC), receive approval, comments and issue a response
  2. Present rule to FSSA rules committee
  3. Submit proposed rule and small business impact to Indiana Register
  4. Receive authorization to proceed from Indiana Register
  5. Schedule and submit notice of public hearing to Indiana Register, Indianapolis Star and FSSA Website
  6. Hold public hearing
  7. Respond to public hearing comments
  8. Letter to FSSA Secretary with analysis of public comments and recommendation for approval
  9. Adopt rule
  10. Issue notice of adoption to Indiana Register
  11. Present final rule to FSSA rules committee
  12. Submit rule to Attorney General's Office
  13. Attorney General's Office submits rule to Governor's office
  14. Rule takes effect 30 days after filing with Legislative Services Agency (LSA)
  15. Governor's office files the rule with LSA
